Welcome to Niva Furniture (“Niva”, “we”, “our”, or “us”). These Terms of Use (“Terms”) govern your access to and use of our website https://nivafurniture.com (“Platform”) and all services and products made available through it (“Services”). By using our Platform, you agree to these Terms.

1. General

These Terms include but are not limited to our Privacy Policy, Shipping & Delivery Policy, and Return & Cancellation Policy, which collectively form a legally binding agreement between you (“User”, “you”, “your”) and Niva Furniture.

By registering, browsing, or placing an order on the Platform, you agree to these Terms and confirm that you are of legal age and capacity to enter into this agreement.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts under Indian law to use our Platform and Services.

3. Account Registration

To place an order, you may be required to register and create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized access to your account.

4. Orders, Cancellations & Returns

No Cancellation or Return Policy

Once an order is placed with Niva Furniture, it is considered final and cannot be cancelled or returned under any circumstances.
This applies to all categories, including but not limited to:

  • Customised furniture

  • Modular kitchens

  • Wardrobes

  • Tables, sofas, storage units, and decor items

Please review all specifications carefully before placing your order.

5. Shipping & Delivery

  • Delivery time for movable furniture (e.g., wardrobes, tables, sofas, storage units) is approximately 15 - 21 days from design finalization depending upon design and level of customization.

  • Delivery time for non-movable furniture (e.g., modular kitchens) is approximately 30 days from design finalization.

  • Transportation and delivery charges will be borne by the customer.

6. Use of Platform

You agree to use the Platform for lawful purposes only and in accordance with these Terms. You shall not:

  • Misuse the website for fraudulent or illegal activities

  • Post, share, or transmit harmful, defamatory, or unlawful content

  • Interfere with the functionality or security of the Platform

  • Attempt to reverse engineer or replicate the Platform’s content or software

7. Limitation of Liability

Niva Furniture shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Platform or purchase of any product.

8. Amendments

We reserve the right to update or modify these Terms at any time. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.

The Platform (https://nivafurniture.com) may contain links to third-party websites, products, services, advertisements, or other content (“Third Party Resources”) that are not owned or controlled by Niva Furniture. These links are provided for your convenience only and do not constitute an endorsement or recommendation by Niva Furniture.

By accessing any Third Party Resources, you acknowledge and agree:

  • You are doing so at your own risk.

  • You are solely responsible for reviewing and complying with any applicable terms, policies, or conditions of those third parties.

  • Niva Furniture does not control and is not responsible for the content, accuracy, privacy practices, or any activity of such third-party sites or services.

You expressly release and hold Niva Furniture harmless from any loss, liability, or damage incurred as a result of your use of or reliance on any Third Party Resources.

Disclaimer of Liabilities

You expressly understand and agree that, to the maximum extent permitted by applicable law and unless otherwise expressly specified, the platform, products (including but not limited to furniture, furnishings, and related services), and services are provided by Niva Furniture on an “as is” and “as available” basis without warranty of any kind, express, implied, statutory or otherwise, including the implied warranties of title, non-infringement, merchantability, or fitness for a particular purpose, unless specifically stated otherwise.

Your interactions and transactions with organizations and/or individuals (including third-party vendors and service providers) found on or through the platform, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such organizations and/or individuals. You are advised to independently verify the credentials and reliability of such third parties before proceeding. In the event of a dispute between you and any third party, you hereby release Niva Furniture, its directors, officers, employees, agents, and affiliates from all claims, demands, and damages (actual and consequential) arising out of or in any way related to such disputes.

Without limiting the foregoing, Niva Furniture makes no representation or warranty that:

  • the platform or services will meet your requirements;

  • your use of the platform or services will be uninterrupted, timely, secure, or error-free;

  • the results from using the platform or services will be effective, accurate, or reliable;

  • the quality of the platform, products, or services will meet your expectations;

  • any errors or defects will be corrected; or

  • the credentials, images, or descriptions of any products or services are accurate, complete, or reliable.

No advice or information, whether oral or written, obtained from Niva Furniture or through the platform shall create any warranty not expressly stated herein.

Niva Furniture shall not be liable for any loss incurred due to unauthorized use of your account or account information, whether or not you are aware of such use.

Although Niva Furniture strives to provide accurate and updated information, it does not warrant or guarantee the completeness or reliability of any content, specifications, or service listed. It is not responsible for delays or inability to use the platform due to maintenance, network issues, or causes beyond its control.

Any content or data downloaded through the platform is done at your own discretion and risk. Niva Furniture will not be liable for any damage to your device, loss of data, or any other harm arising from such downloads.

You may see third-party advertisements or content on the platform. The respective third parties are solely responsible for the content, and Niva Furniture disclaims all liability related to such materials.

Indemnification and Limitation of Liability

You agree to indemnify and hold harmless Niva Furniture, its directors, employees, agents, and affiliates from any third-party claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to your use of the platform or services, violation of these terms, or infringement of any intellectual property or other right of any person or entity.

In no event shall Niva Furniture, its directors, officers, employees, or agents be liable to you or any third party for any direct, indirect, incidental, consequential, special, or punitive damages including loss of data, loss of profits, loss of goodwill, or other intangible losses, whether arising from your use or inability to use the platform or services.

Notwithstanding anything to the contrary, nothing in these terms shall limit or exclude liability for any liability that cannot be excluded under applicable law.

Strict No-Cancellation and No-Return Policy

Once an order is placed with Niva Furniture, it cannot be cancelled, modified, or returned for any reason, including dissatisfaction with the product or change of mind.

Customers are expected to review all product specifications, customizations, dimensions, and delivery timelines before placing an order. Payments once made are non-refundable. This applies to all furniture and services purchased directly or indirectly through Niva Furniture, including custom orders and Niva Door Gallery products.

Term, Violation, Suspension and Termination

These terms shall remain effective for as long as you continue to access or use the platform or services. Niva Furniture may suspend or terminate your account or restrict access without prior notice if it believes you have violated any term, misused the platform, or acted unethically. Your access may be permanently terminated and data removed, except for transaction records maintained for compliance.

Violation of these terms may cause irreparable harm to Niva Furniture, for which monetary damages may be inadequate. Therefore, Niva Furniture reserves the right to seek injunctive relief or any other remedy under law or equity.

Relationship Between Parties

Nothing in these terms creates a joint venture, partnership, agency, or employment relationship between you and Niva Furniture. Both parties agree to act independently and on a principal-to-principal basis.

Anti-Bribery Policy

Users must not engage in bribery, offer unlawful incentives, or violate anti-corruption laws while using the platform. Breach of this provision will result in immediate account termination.

Anti-Discrimination and Sexual Harassment Policies

Niva Furniture maintains a zero-tolerance policy toward discrimination and sexual harassment. Users, vendors, and partners must uphold respectful conduct regardless of sex, race, religion, or other protected characteristics. Violations will result in immediate termination of access and reporting to appropriate authorities if needed.

Report Abuse or IP Infringement

To report abuse, objectionable content, or violations of these Terms, please write to us at grievanceofficeratniva@gmail.com.

To report intellectual property infringement, please include the following:

  • Your full contact information;

  • The IP you believe is being infringed;

  • Sufficient details of the allegedly infringing content and its location on our platform;

  • A good-faith statement of unauthorized use; and

  • Your physical or electronic signature.
